The Influence of Politics on Law: The Interaction between Political Decisions and Legal Justice

This article examines the influence of legal politics on law-making in Indonesia and the relationship between political decisions and legal justice. Political intervention in the legal domain produces adverse effects capable of generating injustice and imbalance within the judicial system. To address those effects, the state must guarantee the independence of legal institutions, avoid the politicisation of law enforcement, and strengthen accountability within the judiciary. Such measures are expected to help form a society that is just, secure and equitable, and to reinforce public confidence in both the legal system and the government. The research question is to what extent legal politics influences the formation of law in Indonesia. The study employs a normative juridical approach. The findings show that legal politics exerts a substantial influence on law-making in Indonesia, and that in practice the political role is frequently not exercised as it ought to be, with law enforcers instead prioritising the interests of political elites.
